Ok, after checking and re-checking the 4x4 system and noises from the transfer case, i have almost come to the conclusion that its not the t-case at all. I tested the 4 wheel drive out and all of the ranges worked, if it was going bad or bad would the 4 wheel drive work? Also, when i'm accelerating, a shudder starts at about 13-1400 rpm's in 3rd gear and continues up through fifth and levels out at fifth. What could this be caused by, maybe a bad u-joint or a bad set of gears in either diff?
Sounds like you have some drivetrain vibes. Do you have any drop install on the trans/skid plate. If not you may want to add a few washers and see if that helps. Really quick and easy. Sure it could be the u-joints.

I don't remember, do you have any lift? What size tires? Even with no lift I got vibes after I install my 31's.
could be tire related what speeds does it start at
4" of lift 33" tires, and no we don't have any but that is a good idea, i may grease the u-joints tonight and see if that helps. What kinda vibes did you get? mine aren't that intense but it shakes the gauge cluster and the area around the radio.
4" of lift would probably benefit from a tcase drop. Buy some 1" square tubing and some grade 8 bolts. 20-30 bucks should fix you right up. Even if this is not the problem, it will add life to your ujoints.

X2 that is what I would try 1st. I have a skyjacker drop for a 97-02 TJ you can have (free) if you want it. I had to make mine because it's a 04. Not sure what model your jeep is.
Mine is a 98, i'd love to get that off your hands man. I gotta get it when i get back into town though, i'm over at my house in Charleston until the sixth but the seventh i'll be back in Mississippi. I'm going to grease up the u-joints just to be sure, and a buddy at Tuffy (a car repair shop here) is going to let me use a lift for a while so i can listen up close and personal to the transfer case/tranny to see if anything is jigglin about. If it's a big fix i'm going to tow it back, anyone willin to help since my dad is going to be working?
